Navigating the Wenham Tree Protection Policy
Wenham is celebrated for its historic charm, rural New England character, and pristine canopy. To protect these natural assets, the Select Board established the Wenham Tree Protection Policy. This municipal policy safeguards existing trees and promotes new plantings to enhance town aesthetics, protect real property values, manage stormwater runoff, and preserve critical habitats for endangered amphibians in local vernal pools.
Whether you are planning a residential estate expansion, managing mature hardwoods, or addressing storm-damaged timber, understanding local tree ordinances is essential for maintaining compliance in Wenham.
Key Requirements of the Wenham Tree Bylaw
Definition of Public Shade Trees
Under Massachusetts General Law (M.G.L. c. 87) and local policy, a Public Shade Tree includes any tree located within the public right-of-way or on adjoining private land within 20 feet of the public way layout.
Tree Warden Jurisdiction
The Town Tree Warden—a Certified Arborist appointed by the Select Board holding credentials from the International Society of Arboriculture (ISA) or the Massachusetts Arborists’ Association—has full care and control over all public shade trees..
Permit & Public Hearing Notice
Property owners and contractors cannot cut, trim, or remove any public shade tree without a written permit from the Tree Warden. Obtaining a permit requires a public hearing with at least 5 business days’ notice published on the town website and in a local newspaper.
Consolidated Hearings
To streamline project approvals, tree removal hearings are consolidated into a single public hearing with the Planning Board (for Scenic Roads designations or Site Plan Reviews) or the Wenham Conservation Commission (when trees fall within wetland resource areas or buffer zones).
Emergency Tree Removal Exceptions
The Tree Warden may authorize immediate tree removal without a public hearing if a tree is dead, structurally dangerous, in imminent danger of falling, or poses a severe threat to structures.
